So , In the war on terror, for the terrorist anything is ok, blowing up busses, schools, markets, sawing off?

If it has reached the point where we must throw our values and morals out the window, why hasn't Congress declared war? If terrorists are the lowest, most evil members of humanity, wouldn't stooping to their level make us just as evil? If we are truly better than terrorists, then we must act like it.
